• All products (kites/lines etc) should be dry before being sent
• All products (kites/lines etc) should be free of debris like sand (sewing machines and sand don't mix)
• Please include a description of the conditions you were flying in (wind speed, gusty or not, strap setting if applicable)
• Please include in the description what happened to the product during the accident (did the kite impact the ground or possibly with another object?)

Terms & Conditions of Sale

1.       Other documents do not apply.
These terms and conditions may not be supplemented, altered or modified by the use of any other document(s). Any attempt to modify, supplement or amend these terms and conditions will be null and void unless agreed to in advance in writing by CWR.

2.       Payment Terms.
Terms of payment shall be determined at the discretion of CWR and otherwise agreed to by CWR. CWR must receive payment prior to CWR's acceptance of customer's order. Payment shall be made by credit card or some other pre-arranged method of payment acceptable to CWR. Where payment is made by credit card, such payment is subject to the approval of the financial institution issuing the credit card and CWR shall not be liable in any way if such financial institution refuses to accept or honor the credit card for any reason.

3.       Prices, Shipping, Handling Charges, Taxes and other charges.
CWR will only ship to Canadian locations. Prices do not include charges for shipping, handling, insurance, taxes or other similar fees, duties or imposts. Separate charges for shipping and handling will be shown on the invoice. CWR is obligated to charge sales tax for deliveries within the Province of Ontario. Unless customer provides CWR with a valid and correct tax exemption certificate applicable to the product ship-to location prior to CWR's acceptance of the order, the Customer is responsible for sales tax and all other taxes associated with the order.

4.       Product Availability.
Product availability may be limited. Products may not be available for immediate delivery. CWR reserves the right, without liability or prior notice, to revise or cease to make available any or all products or to cancel any order. If there is any revision or cessation, CWR may ship products which have substantially similar functionality and specifications to the products ordered.

5.       Force Majeure.
CWR SHALL NOT BE LIABLE IF IT IS UNABLE TO PERFORM ANY OF ITS OBLIGATIONS CONTAINED IN THESE TERMS AND CONDITIONS DUE TO, DIRECTLY OR INDIRECTLY, THE FAILURE OF ANY MACHINE, SYSTEM OF AUTHORIZATION, DATA PROCESSING OR COMMUNICATION SYSTEM OR TRANSMISSION LINK OR ANY INDUSTRIAL DISPUTE, WAR, FLOOD, EXPLOSION, ACT OF GOD OR ANY OTHER EVENT BEYOND THE CONTROL OF CWR.

6.       Governing Law and Jurisdiction.
The sale of products and these terms and conditions are governed by and construed in accordance with the laws of the Province of Ontario, Canada, excluding its choice of law provisions. Each party hereby consents to the exclusive venue and jurisdiction in the provincial and federal Courts located in the Province of Ontario for resolution of all disputes.

7.       Export Control.
Products purchased or received under these terms and conditions are subject to export laws and regulations of Canada.

8.       Headings.
The headings of each of these terms and conditions are for convenience of reference only and shall not form part of these terms and conditions. Such headings shall be ignored in the interpretation or construction of any of these terms and conditions.

9.       Return Policies.
ALL SALES ARE FINAL. If an item is damaged during shipment, CWR will exchange that item for the same item only. All claims for damaged items must be made within 24 hours after you receive your shipment in order to receive an exchange. All damaged items must be properly filed immediately with the shipping company upon delivery of the item. In the event of an exchange caused by shipping damage, the damaged items must be returned to CWR before a replacement item will be shipped. We will issue you a company credit if we cannot replace your item. Any return must first be agreed upon by CWR. Any item being returned must be in new unused condition and in the original packaging supplied by the manufacturer and must have all parts, pieces, and accessories that were included with the product at the time of sale. CWR offers NO CASH REFUNDS for any products or services, regardless of condition or circumstance. Please e-mail all damaged claims immediately to CWR or contact CWR directly by phone or in person.

CWR RESERVES THE RIGHT TO HAVE THE FINAL DECISION IN ALL MATTERS REGARDING RETURNS, REPLACEMENT ITEMS, AND STORE CREDIT.

10.    Products.
CWR's policy is one of on-going updates and revisions. CWR may revise and discontinue products at any time. CWR will ship products that have substantially similar functionality and performance to the products ordered, but changes between what is shipped and what is described in a specification sheet or catalog are possible.

11.    Service and Support.
CWR endeavors to provide the best customer and technical support. For end-user customers, CWR's support personnel will attempt to address problems with CWR's products over the telephone and/or e-mail.

12.    No Assignment.
Customer may not assign any of its rights or obligations under this Agreement without the express written consent of CWR.

13.    Invalidity of Provisions.
If any provision or provisions of this Agreement shall be held to be invalid, illegal or unenforceable, such provision shall be enforced to the fullest extent permitted by applicable law, and the validity, legality and enforce ability of the remaining provisions shall not in any way be affected or impaired thereby.

By accepting delivery of any products distributed or manufactured by Canadian Wind Rider Inc. (“CWR”), the customer agrees to be bound by and accepts the following limited warranty with respect thereto. CWR reserves the right to change the terms and conditions thereof without prior written notice at any time, at its sole discretion.

The following limited warranty gives the customer specific legal rights. The customer may also have other legal rights which vary from province to province or country to country. Some provinces and countries do not allow the exclusion or limitation of incidental or consequential damages or warranties, so the above limitations or exclusions may not apply to certain customers. If it is determined by a court of competent jurisdiction that a certain provision of this limited warranty does not apply or cannot be enforced, such determination shall not affect any other provision of this limited warranty and all other provisions shall remain in effect.

All products sold through our authorized dealers or purchased directly from CWR come together with the standard manufacturer’s warranty. Please familiarize yourself with the terms of any such warranty and assure that all necessary steps are taken to maintain it (including completion and filing of any required Warranty Registration form(s)).   

Under no circumstances will CWR be liable for, or assume any liability for, any product which is not manufactured or assembled by it and for which it has only acted as an agent or distributor.

In any event, under no circumstances will CWR assume responsibility for any product(s) not purchased from it.

Products Manufactured by CWR

Products manufactured or assembled directly by or on behalf of CWR come with a 12 month warranty against defect. Warranty claims should be made at point of purchase or, if purchased directly from CWR, by e-mail addressed to news@CanadianWindRider.com.

Notwithstanding any provision to the contrary, there is no warranty for any CWR product that has been subject to misuse, neglect, negligence or accident, or that has been operated in any way contrary to the operating instructions or normal and accepted use. Further, there is no warranty with respect to any damage to a CWR product that is the result of improper maintenance or to any CWR product that has been altered or modified so as to adversely affect the product’s operation, performance or durability or that has been altered or modified so as to change its intended use. Any applicable warranty does not extend to repairs required for normal wear or by the use of parts and accessories which are either incompatible with CWR product or which adversely affect its operation, performance or durability.

SAVE AS HEREINAFTER PROVIDED, CWR DISCLAIMS ALL WARRANTIES WITH RESPECT TO PRODUCTS MANUFACTURED OR ASSEMBLED DIRECTLY BY IT OR ON ITS BEHALF, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT OR OTHER VIOLATION OF RIGHTS. CWR DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE, VALIDITY, ACCURACY, OR RELIABILITY OF, OR THE RESULTS OF THE USE OF, OR OTHERWISE RESPECTING, ITS PRODUCTS.

THE FOREGOING LIMITED WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTY HEREIN, WHETHER IMPLIED BY LAW OR OTHERWISE.

Subject to the foregoing, the specific warranty covering each CWR product is governed by the law of the Province of Ontario, Canada, and applies only to products manufactured or assembled by CWR and purchased from an authorized CWR retailer or directly from CWR.
